U.S. further restricts Huawei


Effective 20th August 2020, the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) has modified controls on Huawei and its listed non-U.S. affiliates. This ruling:

  1. adds 38 additional non-U.S. Huawei affiliates to the Entity List.

  2. removes a temporary general license for Huawei and affiliates and replaces it with a more limited permanent authorization that excludes certain additional exports, reexports, and transfers (in-country).

  3. amends General Prohibition Three, also known as the foreign produced direct product rule.

  4. clarifies the Entity List’s supplemental licensing requirements to state that the end-user controls apply to listed entities if they are acting as a purchaser, consignee, or end-user (as defined in the Export Administration Regulations (EAR)).
